Introduction

Welcome to TheJobApplier, a service that streamlines job applications by securely storing your data and helping you complete forms on third‑party job sites.

These Terms of Service (the “Terms”) form a legally binding agreement between you and TheJobApplier. By accessing or using the service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Effective as of: January 25, 2025. These Terms apply from account creation or first use of the service.

We may suspend or terminate an account or subscription in our sole discretion for violations of these Terms or prohibited conduct (including misuse, fraud, or abuse of subscription privileges).

Eligibility

To use TheJobApplier, all of the following must be true:

  • You are at least 18 years old.
  • You have the legal capacity to enter into a binding agreement in your jurisdiction.
  • You are legally permitted to apply for jobs where you live and work, in accordance with applicable labor and employment laws.
  • You are responsible for ensuring your use of the service complies with all applicable laws and regulations.

If you do not meet these requirements, you may not use the service. We may suspend or terminate ineligible accounts.

Account Creation and User Responsibilities

To access certain features, you must create an account and keep your information accurate and secure.

  • Provide accurate and complete registration information. False or misleading information may lead to suspension or termination.
  • Keep your credentials confidential. You are responsible for activity under your account.
  • Notify us immediately at info@thejobapplier.com if you suspect unauthorized access or use of your account.
  • Use the service only as permitted by these Terms and applicable law. Misuse may result in termination.
  • Ensure the data you submit (e.g., resumes, cover letters) is accurate and up to date.

We may suspend or terminate accounts that violate these Terms or engage in prohibited conduct (see User Conduct and Prohibited Activities).

Services Provided

TheJobApplier assists with managing and simplifying job applications. Use of the service is subject to the scope and limitations below:

  • Form‑filling assistance on third‑party job sites using information you provide. You control whether to submit applications.
  • Secure storage of your resumes, cover letters, and application details for tasks you initiate.
  • Interaction with third‑party platforms to facilitate applications. We are not responsible for those platforms’ content, availability, or terms.
  • Future features may include job listing integrations. Such features will be subject to these Terms.
  • No guarantee of interview, hiring, or any application outcome.

The service is a tool to aid the application process; you are responsible for final submissions and outcomes.

Billing and Subscriptions

TheJobApplier may offer paid subscriptions providing additional features.

  • Payments are processed by Stripe. We do not store card data. Stripe’s Privacy Policy governs handling of payment information.
  • Subscription tiers, billing cycles, and renewal policies are shown on our Pricing page. By subscribing, you authorize recurring charges until cancellation.
  • Fees are non‑refundable except as required by law. We do not issue partial‑period refunds.
  • You may cancel at any time in account settings. Cancellation takes effect at the end of the current billing period.
  • If a payment fails, access to paid features may be suspended until resolved.

Data Usage and Privacy

We prioritize privacy and security. This section summarizes how we handle your information.

  • We collect user‑provided data (e.g., resumes, cover letters, form preferences) to assist with applications. Authentication may use Google or Microsoft solely for sign‑in.
  • We use your data only to provide and improve the service and to complete tasks you initiate.
  • You may delete your account or specific data at any time. We may retain minimal information if required for legal or administrative purposes.
  • We comply with applicable privacy laws in Canada and Quebec (including Law 21) and process personal information responsibly.
  • Planned integrations may fetch job opportunities; you will control if and how your data is shared.

User Feedback

We welcome feedback to improve the service.

  • Providing feedback is voluntary and not required to use the service.

  • We are not responsible for issues caused by third‑party platforms or APIs.

User Conduct and Prohibited Activities

To maintain a safe and fair service, you agree to the following:

  • Provide accurate, truthful, and up‑to‑date information.
  • Use the service only for lawful job application–related purposes.
  • Prohibited activities include:
    • Spamming, phishing, or fraudulent activity.
    • Scraping, reverse‑engineering, or tampering with the service.
    • Submitting false or misleading application information.
    • Uploading malware, viruses, or harmful code.
    • Interfering with security, performance, or integrity of the service.
  • Comply with third‑party platform terms when interacting via the service.

Intellectual Property

All content, software, and designs associated with the service are owned by TheJobApplier or its licensors.

  • The service and its content (text, graphics, logos, code, design) are protected by intellectual property laws.
  • We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the service in accordance with these Terms.
  • You may not:
    • Copy, modify, distribute, or reproduce the service or its content without prior written permission.
    • Use our trademarks, logos, or designs without authorization.
    • Reverse‑engineer, decompile, or disassemble any part of the service.
  • You retain ownership of data you upload. You grant us a non‑exclusive, royalty‑free license to process it solely to provide the service.

Disclaimer of Warranties

The service is provided “as is” and “as available.” We do not guarantee uninterrupted, error‑free, or secure operation.

  • We do not warrant the service will be free of errors, interruptions, or vulnerabilities.
  • We do not guarantee the service will meet your expectations; outcomes of applications are not guaranteed.
  • To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

You are responsible for verifying the accuracy and appropriateness of submissions made through the service.

Limitation of Liability

To the maximum extent permitted by law, TheJobApplier and its affiliates are not liable for any damages arising from use of the service, including:

  • Lost job opportunities or application outcomes.
  • Errors, inaccuracies, or breaches caused by third‑party platforms.
  • Losses from unauthorized account access due to failure to safeguard credentials.
  • Indirect, incidental, special, consequential, or punitive damages (including lost profits, data, or goodwill).

Our total liability is limited to the subscription fees you paid in the six (6) months preceding the claim.

Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum extent permitted by law.

Governing Law

These Terms and any disputes are governed by the laws of Canada, specifically the Province of Quebec and the City of Montreal, without regard to conflict‑of‑law rules.

Legal actions must be brought exclusively in the courts of Quebec, Canada. You waive objections to jurisdiction and venue.

If you use the service outside Canada, you are responsible for compliance with local laws; use where prohibited is void.

Dispute Resolution

We aim to resolve disputes fairly and efficiently.

  • First, email us at info@thejobapplier.com with details of your concern.
  • Both parties agree to negotiate in good faith before initiating legal action.
  • If unresolved, disputes will be submitted to binding arbitration under the rules of a recognized arbitration body in Quebec, Canada.
  • Alternatively, eligible claims may be brought in small claims court in your local jurisdiction.
  • IP and unauthorized‑use claims may proceed in the courts of Quebec without arbitration.

Arbitration may be conducted in English or French. Each party bears its own costs unless the arbitrator decides otherwise.

By agreeing to these Terms, you waive participation in class or collective actions where permitted by law.
