1. Eligibility
To use TheJobApplier, you must meet the following eligibility requirements:

4. Billing and Subscriptions
TheJobApplier offers subscription-based services to provide advanced features and functionalities. By subscribing, you agree to the following terms:

10. Disclaimer of Warranties

11. Limitation of Liability

Lost Job Opportunities: The App assists in pre-filling job applications but does not guarantee the acceptance, placement, or outcome of your submissions.

Unauthorized Access: We are not liable for losses resulting from unauthorized access to your account caused by your failure to maintain the confidentiality of your login credentials.

Indirect or Consequential Damages: This includes, but is not limited to, loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
In any event, our total liability to you for all claims arising from or related to your use of the App is limited to the amount you have paid us in subscription fees over the last six (6) months.
Some jurisdictions may not allow the exclusion or limitation of certain liabilities. In such cases, our liability will be limited to the extent permitted by law.

12. Governing Law
These Terms of Service and any disputes arising from or related to your use of TheJobApplier are governed by and construed in accordance with the laws of Canada, specifically the province of Quebec, and the city of Montreal, without regard to its conflict of law principles.
By using the App, you agree that any legal action or proceeding related to these Terms will be brought exclusively in the courts of Quebec, Canada. You waive any objections to the jurisdiction of these courts, including claims of improper venue or forum non conveniens.
If you are using the App outside of Canada, you are responsible for compliance with local laws. Use of the App where prohibited by local law is void and unauthorized.

Exceptions: This dispute resolution process does not apply to claims related to intellectual property rights or unauthorized use of the App. Such claims may be brought directly in the courts of Quebec, Canada.
Arbitration proceedings will be conducted in English or French, as agreed upon by both parties, and each party will bear its own legal costs unless otherwise awarded by the arbitrator.
By agreeing to these Terms, you waive the right to participate in class actions or collective legal proceedings against TheJobApplier, except where such waivers are prohibited by applicable law.
